Battery Domestic Violence with a Deadly Weapon

My Charge Says That I Used a Deadly Weapon. What Does This Mean?

Although charged under essentially the same set of facts as a normal Battery Domestic Violence case, a charge for Battery Domestic Violence with a Deadly Weapon carries a far more severe penalty. The same holds true if the State is alleging the Domestic Violence resulted in Substantial Bodily Harm. What is important to know, is that a Deadly Weapon can be just about any object, it does not have to be a gun or a knife. Sticks, belts, coat hangers, vases, picture frames, garbage bags, virtually any number of household items can, and are, charged as “deadly weapons” if there is an allegation such an item was used in a way that either caused, or was likely to cause, substantial bodily harm or death. If you have a fight with your spouse and throw a potted plant at them, you could be charged with Battery Domestic Violence with the use of a Deadly Weapon.
